Information on exercising the right to withdraw from the contract

Standard instructions regarding refusal:

The right to withdraw from the contract applies only to individuals!

1. Right of withdrawal

In accordance with Article 50 of the Consumer Protection Act (ZPP), the consumer has the right to withdraw from a distance contract without giving any reason, without being liable for damages or penalties and without incurring any costs, except for the costs of returning the goods. The time limit for exercising the right of withdrawal is 14 (fourteen) days, starting from the date on which the consumer or a third party, other than the carrier and designated by the consumer, received the goods.

2. How it is exercised

In order to exercise their right of withdrawal, the consumer must inform the trader by means of an unequivocal statement, using one of the following methods:

  • By email, to the address: …………;
  • Using the standard withdrawal form attached at the end of this document;

The burden of proof regarding the exercise of the right of withdrawal lies with the consumer. It is recommended that the notice be sent by a means that provides confirmation of receipt (for example, by email with read receipt or by registered post).
The withdrawal period is deemed to have been met if the consumer has sent the notice before the expiry of the 14-day period.

3. Returning goods

Once the notice of withdrawal has been submitted, the consumer is obliged to return the product within 14 (fourteen) days. The product should be sent to the following address: Sofia, 1 Kukush Street.

The costs of returning the product are borne by the consumer, unless the trader has expressly stated otherwise for a specific order or promotion.

The product must be returned in the same condition as it was received, together with the packaging, documentation and related accessories. The consumer is liable for any reduction in the value of the goods resulting from handling them in a manner other than that necessary to ascertain their nature, characteristics and functioning.

4. Refund of the amount paid

The trader shall refund all payments received from the consumer, including the initial delivery costs (excluding any additional costs relating to the delivery method chosen by the consumer, other than the cheapest option), within 14 (fourteen) days of the date on which the merchant received the notice of withdrawal.

The trader is entitled to defer the refund until the goods have been returned. The refund shall be made using the same method of payment as that used for the original transaction, unless the consumer has expressly agreed to a different method, provided that this does not entail any additional costs for the consumer.

5. Exceptions to the right of withdrawal
In accordance with Article 57 of the Consumer Protection Act, the right of withdrawal does not apply in the following cases:

  • custom-made cornices or those tailored to the customer’s individual requirements;
  • products which, by their very nature, cannot be returned or which are liable to deteriorate or expire rapidly;
  • products with damaged sealed packaging, as well as other products that cannot be returned for hygiene reasons.

Given the nature of certain products on offer (e.g. mattresses, protective covers, pillows), the right of withdrawal does not apply if the product’s sealed packaging has been opened, for hygiene reasons.

If you exercise your right of withdrawal in respect of furniture, it must be returned in its original packaging, disassembled, in the same condition as it was delivered, together with all fixings, documents, instructions, etc.

The consumer is obliged to retain the Product received and to ensure that its quality is maintained. The integrity of the label or the original packaging must not be compromised. The products must not show any signs of impact, mechanical damage, disassembly or repairs carried out by unauthorised persons.

In the event of a breach of these conditions, or if it is found that the Product has been used to a greater extent than is necessary for its normal testing, the Company reserves the right to refuse to accept the returned Product and, consequently, not to refund the amount paid by the Consumer.
